Terms & conditions
(relating to the LAG website, books, training, Legal Action magazine, Community Care Law Reports and membership)
1 Acceptance of order
No contract will subsist between us for the sale by LAG to you of any product or service unless we accept your order. Other than as set out in paragraph 7 that acceptance occurs when we despatch the goods to you, notwithstanding any previous communications between us. LAG reserves the right to require a written order form from you before accepting your order.
Please note: taking payment online by credit/debit card does not indicate acceptance of the order. While your card may be debited before an order is accepted, if the order is ultimately rejected, an immediate refund will be made.
2 Pricing and taxes
All prices are subject to change without prior notice. However, we try to keep all publicly available sources of price information regularly updated.
All online prices include VAT at the current rate where applicable.
Prices also include delivery charges, unless otherwise stated. For books orders: £3.50 will be added to your total books order to cover postage and packing if you are based in the UK, regardless of the number of books purchased. For Europe and the rest of the world, call Marston Book Services for a quote (telephone: 01235 465577 or e-mail: firstname.lastname@example.org).
The description and price of goods will be confirmed in the despatch note and/or invoice.
Books, Legal Action magazine and Community Care Law Reports
For book orders, if Marston Book Services agrees to invoice, all payments must be received within 30 days, unless otherwise agreed. For Legal Action magazine and Community Care Law Reports, if LAG agrees to invoice, all payments must be received within 30 days, unless otherwise agreed.
Booking forms should be accompanied by payment. Any request to pay fees by invoice will be considered, but LAG reserves the absolute right not to invoice and to request immediate payment. If LAG agrees to invoice, all outstanding fees must be paid within 14 days of the date of the invoice. In any event, all payments must be received at least seven days in advance of the course date, unless otherwise agreed with LAG. If these conditions are not complied with, LAG reserves the right to cancel the course booking.
Delivery to addresses within the UK and EU may take up to seven working days. Delivery to the rest of the world can take up to 30 days. Our carriers may attempt delivery during office hours - we therefore advise that you provide a shipping address where you, or a representative, can sign for delivery. All costs and delivery details will be provided in the despatch note and/or invoice.
Joining instructions will be sent before the course. Course materials will be provided on the day.
If you decide you do not want a particular book, you can return it within 30 days of purchase and we will refund the cost of the book as long as it is received by Marston Book Services in a saleable condition (Marston Book Services, Direct Mail Department, 160 Eastern Avenue, Milton Park, Abingdon, Oxfordshire OX14 4SB). Please send a copy of the invoice with the return. It is recommended that books are returned via a traceable method. See also: the trade returns policy.
If a book has been sent in error, Marston Book Services will send out the correct book and cover any additional delivery charges.
All cancellations must be made in writing. Please note that if cancellation occurs up to 15 days before the course start date, the course fee will be refunded but LAG will charge an administration fee of £30 + VAT. If cancellation occurs 14 days or less before the course start date, the full course fee + VAT is payable.
A substitute delegate can be named at any time free of charge.
LAG reserves the right to vary or cancel a course where necessary, and as much notice as possible will be given to delegates. Where a course is cancelled, LAG will automatically make a full refund, but disclaim any further liability.
6 Right to cancel
Under the Distance Selling Regulations you have the right to cancel your purchase within seven working days beginning with the day after the day on which the product was received (but see paragraph 7 below). On receipt of the product in its original condition we will refund the price you paid for the product. Please note: you will be responsible for the delivery costs of returning the product to us. For your own protection, we recommend that you use a recorded-delivery service when returning any product to us, so that you have proof of return.
7 Cancelling subscription services
Any subscriptions to Community Care Law Reports and Legal Action magazine are deemed to start from the receipt of your completed order or registration form. Cancellation by you must be made in writing. No refund will be given if you cancel a service part way through a subscription year.
Please note that Community Care Law Reports subscriptions run annually (from January to January) and you will receive backdated copies if you start your subscription part way through the year whereas Legal Action magazine subscriptions can start at any time.
8 Data protection
LAG recognises the importance of protecting the privacy of all information provided by users of our website, subscribers to our magazine and the Community Care Law Reports, purchasers of our publications, attendees of our training courses and members of LAG. We have created this policy with a fundamental respect for our users' right to privacy and to guide our relationships with our users. This privacy statement discloses the privacy practices for all products and services owned by LAG.
Information collection and use
Ordering products or
We collect contact details and credit card information where applicable (such as account name, number and expiry date). Customer details are added to the LAG database in order to process an order and for billing purposes only, and are not otherwise shared.

We may communicate with a user to provide requested products or services and for account-related issues via e-mail, phone, fax or regular mail. We also offer users the option to receive information about our organisation, courses, publications, members scheme and special deals.
We have features where users can submit information to us (such as our feedback forms). Letters to the editor and similar submissions may be made public. Requests for service, support or information may be forwarded as needed to best respond to a specific request. We may retain e-mails and other information sent to us for our internal administrative purposes, and to help us to serve customers better.
With whom your
information is shared
LAG does not sell, trade or rent users' personal information to others.
If a user's personally identifiable information changes (such as address), or if a user no longer desires our product(s)/service(s), we provide a way to correct or update that user's personal data. Users can indicate online at checkout, over the phone when placing an order or via an order form which is faxed, e-mailed or mailed if they DO NOT wish for their personal information to be used by LAG for marketing purposes.
We use reasonable precautions to protect our users' personal information and to store it securely. Sensitive information that is transmitted to us online (such as credit card number) is encrypted and transmitted to us securely. In addition, access to all of our users' information, not just the sensitive information mentioned above, is restricted. Only employees who need the information to perform a specific job (for example, a billing clerk or an administrator) are granted access to personally identifiable information. Finally, the servers on which we store personally identifiable information are kept in a secure environment.
Our website contains links to other sites. LAG is not responsible for the privacy practices or content of these other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each website to which we may link that may collect personally identifiable information.
Notification and changes
LAG is registered with the Information Commissioner's Office and you can view our entry on the Data Protection Register at: http://www.ico.gov.uk/.

9 Special trading terms
Any supply to a bookseller, wholesaler or other distributor under favourable trading terms will be subject to a separate supply agreement negotiated with that organisation. See also: LAG's trade returns policy.
10 Reliance on our products/services
LAG's books, Legal Action magazine, the Community Care Law Reports, training notes and information on the LAG website are provided for reference purposes only and are not intended, and should not be used, as a substitute for professional advice or judgment or to provide legal advice about particular circumstances.
While reasonable efforts are made to keep LAG's books, Legal Action magazine, the Community Care Law Reports and training notes up to date, you should obtain independent verification or advice before relying on any piece of information in circumstances where loss or damage may result.
11 LAG mission
In accordance with LAG's organisational aims and mission, our courses, books, Legal Action magazine and Community Care Law Reports are intended to offer high quality legal training and information to aid the vulnerable, socially excluded or otherwise disadvantaged.
LAG reserves the right to amend these terms and conditions from time to time.
13 Governing law and jurisdiction
Contracts for the supply of products/services between us will be concluded in the English language, shall be construed in accordance with the laws of England and shall be subject to the exclusive jurisdiction of the English courts.
