On the facts, social workers engaged in terminating the local authority’s relationship with a care home had not been guilty of misfeasance in public office
Facts: owners of a residential care home claimed that local authority social workers, involved in the cessation of referrals to the home and, ultimately, the moving of all residents to other homes, were guilty of misfeasance in public office.
Judgment: Mitting J held that there had not been any misfeasance in public office: the social workers involved had suspended referrals out of concern for the residents and they had not bullied or lied to residents, who had freely chosen to leave the home.
