Cancellations and returns
In law, you have various rights as a consumer including the right to claim a refund, replacement, repair and/or compensation where the goods are faulty or incorrectly described. This document states the returns and cancellation policies for all LAG products in addition to your legal rights. It does not affect those rights in any way. You can use our model cancellation form to cancel an order and request a refund or replacement, but any email, phone call or letter indicating your name and address, the item or service that you wish to cancel, and the details of your purchase, will suffice.
Print books
Orders for print books made through our website are fulfilled by our distributor, Marston Book Services. Returns must be made to them, in accordance with their returns policy. Books must be in resaleable condition and returned within three months.
Very infrequently, we fulfil print book orders direct from the LAG office. In such cases, you have 28 days in which to inform us that you wish to return the item and receive a refund, and a further 14 days to return it. Your refund will include the cost of the book plus the original cost of postage, but you will have to cover the cost of return postage. If the book is damaged upon its return, and the damage has not occurred in transit, we reserve the right to reduce your refund appropriately.
If you receive a damaged book (and it was not sold as damaged), or the wrong book, let us know, return the item, and we will either replace it or refund you, whichever you prefer. We will process your refund within 14 days of receiving either the book back or proof of postage, whichever is sooner. If you return the book more than six months after receiving it, we may ask for proof that it was damaged when you received it.
eBooks
Once you purchase a LAG eBook, you have 28 days in which to change your mind and request a refund if you have not downloaded it. Once you have successfully downloaded the eBook, you are no longer eligible for a refund.
Bundles
Bundles combine a print book and an eBook. From 18/3/2020 to 31/07/20 the price includes a print book at full price, and a free eBook. Thus, Bundle refunds are subject to the same policy and procedures outlined for print books above. Once you purchase a LAG Bundle, you have 28 days in which to change your mind and request a refund if you have not downloaded the eBook. Once you have successfully downloaded the eBook, you are no longer eligible for a refund. We may in exceptional circumstances consider a partial refund on the print portion of the bundle if considered to be in a saleable condition. However, please contact LAG regarding any bundle refunds, rather than Marston Book Services.
Legal Action Magazine
Subscriptions to Legal Action magazine can be cancelled at any time. If you inform us that you wish to cancel a subscription within 14 days of taking it out, a full refund will be given. If you inform us after 14 days, a refund will be granted of the entire cost of your subscription minus the value of any print magazines already received. That value will be calculated on the following basis, assuming that ten print magazines are published in any calendar year: (cost of subscription for 12 months / 10) x number of issues received.
CCLR
Subscriptions to Community Care Law Reports can be cancelled at any time. If you inform us that you wish to cancel a subscription within 14 days of taking it out, a full refund will be given. If you inform us after 14 days, a refund will be granted of the entire cost of your subscription minus the value of any print issues already received. That value will be calculated on the following basis, assuming that four print issues are published in any calendar year: (cost of subscription for 12 months / 4) x number of magazines received.
Events
All cancellation of places at events such as training courses and conferences must be made in writing (ie by email or using the cancellation form). Cancellations with more than 30-days’ notice will receive a full refund. If cancellation occurs between 30 and 15 days before the course start date, LAG will refund the course fee minus an administration fee of 15%+VAT on the net booking rate selected. If cancellation occurs less than 15 days before the course start date, the course fee, including VAT, is non-refundable.
Membership
Membership can be cancelled at any time, and a refund will be for the period left to run on the following basis: (cost of annual membership / 365) x number of days left of membership, minus a £5 administration fee.
Complaints and disputes
It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations, please contact us.
Please direct any complaints to lag@lag.org.uk and we will endeavour to address your complaint thoroughly. Your complaint will be acknowledged within three working days and a likely timescale provided for resolving the dispute. We will keep you informed about the progress of your complaint.
Delivery charges
All print books are subject to a £3.50 delivery charge unless otherwise stated.
eBooks
Most LAG books are available as eBooks in ePub format. This format is compatible with many devices and eReading apps and programs, but cannot be opened in Adobe Reader or Acrobat, in web-browsers, or in any standard Microsoft Office program. Adobe Digital Editions, a program available for Windows, macOS, iOS and Android, is an example of a free eReading program compatible with LAG eBooks. Various other programs and apps are also available that will display ePub files. It is the responsibility of the customer to check that they have the capability to use a LAG eBook prior to purchasing or downloading it.
As stated in our cancellations and returns policy, once you have purchased an eBook from LAG, you have 30 days in which to change your mind and cancel your purchase. However, this cancellation period ends immediately if you download the ePub file. Once an eBook is downloaded, it cannot be returned, and no refund will be given.
In order to allow purchasers to read their eBooks on multiple devices, LAG does not impose technological restrictions on the way in which its eBook files can be handled. However, sharing an eBook is not the same as sharing a copy of a physical book. ‘Sharing’ a digital file involves creating and distributing a copy of the original file and this breaches copyright restrictions. When you buy an eBook you are purchasing an individual licence to access the data, which is not the same as buying a book in print. When you download an eBook it is electronically watermarked for use by the customer who made the purchase, and only that customer is permitted to use it. If you would like to purchase a multi-user licence for an eBook, please contact LAG to arrange a suitable licence.
As well as those sold from our website, LAG eBooks are available in the Kindle format, sold through the Amazon Kindle Store, and subject to Amazon’s own terms and conditions. LAG takes no responsibility for products bought through Amazon or any other third party.
Payment
Online payment for products bought through the LAG website is made via Paypal. When you click to checkout your basket, you will be redirected to Paypal, where you will be given the option pay using an existing Paypal account, or to pay by credit or debit card without using or creating a Paypal account. Paypal provides LAG with the payer’s name, email address the details of payment, but not any card details. Any refunds for online purchases are processed through Paypal, and will be returned to the card used to pay. Use of Paypal does not affect any of the conditions stated in this document.
Payments made by phone or using an order form are processed by LAG through Paypal.
Subscriptions
Legal Action magazine
A subscription to Legal Action magazine provides you with ten print issues of Legal Action each year; a ten per cent discount on LAG training and events; online access to the full content of the current issue; and online access to the fully searchable archive of back issues from 2001 onwards.
Subscriptions are sold initially on a one-year basis, with an upfront payment, and can be taken out through the website, by email or post using the downloadable order form, or by telephone on 020 7833 2931. Subscribers will be sent a renewal form towards the end of their initial subscription period, giving them the chance to renew, and, if they are renewing, to switch to direct debit payments if they should so wish. If a direct debit has been set up, subscribers will be informed in advance that payment is due to be taken, and if the subscription cost or period is changing. If a direct debit is not set up, renewal forms will continue to be sent at the end of each subscription period. As stated in the cancellation and returns policy, a Legal Action subscription can be cancelled at any time, and a refund will be given for the subscription cost minus the value of any print issues already received in the subscription period (as stated above).
Community Care Law Reports (CCLR)
A subscription to CCLR provides four print issues each year and access to the searchable online archive, which includes every case reported since the reports started in 1997. Subscriptions can be bought through the website, by email or by telephone on 020 7833 2931. Subscriptions are usually annual, and subscribers will be sent a renewal form before their subscription lapses, indicating any changes in price.
LAG Membership
The benefits of LAG membership include invitations to the AGM and other select LAG events, opportunities to contribute to LAG's campaigns through email and to our online surveys, and 10 per cent reduction in the price of LAG's training courses and conferences, Legal Action, CCLR subscriptions and all our publications. Membership is annual. It can be taken out through the website, by email or by telephone on 020 7833 2931. Members will be sent a renewal form towards the end of their initial membership period, giving them the chance to renew, and, if they are renewing, to switch to direct debit payments if they should so wish. If a direct debit has been set up, subscribers will be informed in advance that payment is due to be taken, and if the subscription cost or period is changing.
