The tribunal was entitled to adjourn proceedings for evidence to be adduced as to what conditions might be appropriate to attach to a conditional discharge
Facts: DC was a restricted patient, who appealed the decision of the First-tier Tribunal not to order his deferred conditional discharge, but to adjourn for further evidence to decide the appropriate conditions.
Judgment: Upper Tribunal Judge Jacobs held that before a deferred conditional discharge was made, conditions for the discharge had to be identified and included in the direction; the purpose of deferral was to allow time for the specified arrangements to be made. Accordingly the First-tier Tribunal had acted appropriately.
