Facts: Ms B-S was a Jamaican citizen, who was unlawfully present in the UK, with an adult daughter who was also a Jamaican citizen, and two much younger children who were British citizens but who no longer had contact with their father. Lambeth refused to provide any support or assistance beyond assistance to travel back to Jamaica, or accommodation for the children on their own, even though Ms B-S had an outstanding application for LTR on human rights grounds.
Judgment: Dobbs J held that Lambeth’s stance had been lawful: there was no reason to suppose that the children’s needs would not be adequately met in Jamaica and, even then, it may well not violate Article 8 ECHR to accommodate the children only.
