Facts: Ms A was an asylum-seeker with two disabled children, with special accommodation, educational and care needs.
Judgment: the Court of Appeal (Brooke, Waller and Clarke LJJ) held that because of section 122 of the Immigration and Asylum Act 1999, the National Asylum Support Service (rather than Waltham Forest) was under a duty to provide the family with accommodation but that accommodation had to be adequate, taking into account the children’s needs.
