In the absence of negligence, a local authority is not liable for abuse perpetrated by foster carers
Facts: Nottinghamshire had placed NA with two foster families between 1985 and 1988. The first family abused NA physically, the second family abused her sexually. Nottinghamshire had not discharged its functions negligently.
Judgment: the Court of Appeal (Black, Tomlinson and Burnett LJJ) held that Nottinghamshire was not vicariously liable for the abuse and did not have a non-delegable duty of care that made it responsible.
