Part 1: Costs under the Standard Crime Contract (SCC) A1.5
6.1The contract provides for appeals and reviews in the following cases:
Advice and assistance on appeals against conviction or sentence (where a newly instructed representative is not covered by an existing determination) or applications to the Criminal Cases Review Commission (CCRC) provided under section 15(2)(c) of the Act.1Legal Aid, Sentencing and Punishment of Offenders Act (LASPO) 2012.
Representation on an appeal by way of case stated provided under section 16 of the Act.
Representation in the Crown Court under a Representation Order in Prescribed Proceedings on appeal from the magistrates’ court provided under section 16 of the Act.2These proceedings are civil proceedings supported by criminal legal aid and are dealt with in chapter 10.

6.3Work in this class (SCC B11) covers appeals and reviews against conviction and sentence, and representation on appeals by way of case stated, where a newly instructed representative is not covered by an existing representation order. It is paid at hourly rates. The principles applicable are those set out in chapter 1. In relation to appeals against conviction and sentence by a new representative there are extendable costs limits of £456.25 in CCRC cases and £273.75 otherwise. There is no limit for appeals by way of case stated. There is a financial eligibility test.
6.4Representation in the Crown Court in prescribed proceedings on appeal from the magistrates’ court is covered in chapter 10. In appeals in prescribed proceedings the extendable limit is £1,368.75. There are limitations if advice has already been given and other strict contractual requirements.
All figures below refer to matters started on or after 1 April 2016.

6.8As advocates are not party to the SCC, no provision for their fees appears. Reference should be made to appendix J as the fees set out below are as appropriate to the Adminstrative Court (as a Divisional Court) as they are to the Court of Appeal.3Remuneration Regulations 2013 reg 3(9).
