8.1Most applications concerning P’s property and affairs are not contested and are dealt with ‘on the papers,’ ie without a hearing. However some will meet with disagreement. This chapter looks at the steps that are necessary when responding to an application, whether the decision is to consent to it or the party served or notified wishes to oppose it or suggest an alternative order.
8.2Those who are served with application papers, or notified of an application, should consider (where necessary with the benefit of legal advice) as soon as possible how they wish to respond and what part they wish to play in the proceedings. The COPR provide for a number of variations, which will have different consequences for the shape of any proceedings.
8.3All parties should bear in mind the impact of their behaviour on the costs of the matter, a timely response will be most effective at curbing costs.
