25.1The Court of Protection is, almost by definition, a court whose every substantive decision will be taken after balancing different rights arising under the European Convention on Human Rights (ECHR), both those of P and – frequently – those of third parties (most often family members) upon whom the court’s decisions in relation to P will impact. In this chapter, we outline briefly some of the key points that advisers need to consider in relation to the ECHR, in particularly when it comes to seeking redress for breaches of the ECHR. We also touch upon the impact of the Convention on the Rights of Persons with Disabilities (CRPD).
