A failure to discharge the PSED was immaterial in the context of a decision that would not require any particular service being terminated
Facts: Vale of Glamorgan decided, in principle, to close libraries, unless it was possible to develop community-led libraries.
Judgment: Elisabeth Laing J held that, whilst the Cabinet Report had failed to draw attention to the equality impact assessments, or to analyse the potential adverse impacts of library closures, that failure to discharge the PSED did not vitiate the decision, since there had not been an operative decision to close any library and no person had delegated authority to do so. The flaws in the process could be remedied before any closure decision was made.
