It is not necessarily discrimination to levy increased charges on persons in receipt of disability benefits
Facts: Powys imposed higher charges for home care services on persons in receipt of income support plus disability living allowance/attendance allowance, than on persons in receipt of income support only. Mrs Hambidge submitted, inter alia, that this amounted to discrimination in breach of section 20(1) of the Disability Discrimination Act 1995.
Judgment: the Court of Appeal (Henry, Aldous, Laws LJJ) held that there was no discrimination: the charging scheme was based on the level of resources in the hands of those in receipt of care, whether or not the presence of disability lay behind the receipt of cash in a particular case; there was no causal link between the rate charged and disability.
