A possession order was granted where a patient refused to leave the ward
Facts: Ms Price had suffered a broken femur and had undergone a number of operations on her knee but had then refused to leave hospital, despite having been assessed as having the same mobility as before and as being able to manage at home, with social services help.
Held: HHJ Coe granted a possession order. For a similar case, see Barnet PCT v X [2006] EWHC 787 (Admin) (Wilkie J), in which the court granted Barnet PCT possession of a bed in a hospital ward that X had continued to occupy, against Barnet’s wishes and after his treatment was complete, for three years.
