The CCG had been wrong to refuse to review a nursing home resident’s eligibility for NHS continuing healthcare during a period covered by two flawed assessments
Facts: Mr Dennison’s mother had funded her nursing home accommodation prior to her death, after which her son asked the CCG to review whether his mother should have received NHS continuing healthcare throughout her period of residence. The CCG refused to undertake a review for periods of time where it had already completed assessments of the mother’s entitlement to CHC.
Judgment: William Davis J held that two of the assessments in question were flawed in that the CCG had failed properly to consider whether the mother had had a primary health need and CCG would have to review those assessments.
