Interim relief
Interim relief
27.11.1The courts are willing to grant interim relief in public law cases whenever the justice of the case so requires, having regard to the public interest.1R (Medical Justice) v Secretary of State for the Home Department [2010] EWHC 1425 (Admin), at paras 6–16. It can be harder to secure interim relief, however, when the relief sought does not preserve the status quo but requires the public authority to make some new or additional provision.2R v Cardiff CC ex p Barry (1989) 22 HLR 261 at 263; R v Kensington & Chelsea RLBC ex p Hammell [1989] QB 518; R v Camden LBC ex p Mohammed (1997) 9 Admin LR 639 at 643E–H; R (AA) v Lambeth LBC [2001] EWHC 741 (Admin), (2002) 5 CCLR 36.
