Virtual courts
3.6A claim for advocacy assistance for a virtual court appearance is the only claim that may be made if:
a case concludes at a virtual court;
the case is adjourned and a representation order is not granted;
the solicitor declines to represent the client at the next hearing and there is no application for a representation order; or
the solicitor advises the client not to take part in the virtual court and does not represent the client at any adjourned hearing.
3.7No such claim may be made if:
a representation order is granted to the solicitor at the virtual court, when the time involved becomes part of the core cost of the magistrates’ court claim; or
a representation order already exists, and this includes when there is an arrest for breach of bail.
