Costs without a representation order
3.9There are three other possible claims which may be used when a representation order is not granted, but only one may be made for any particular defendant.

3.101)An application for a representation order is made but refused on merits (whatever the means position).
2)The designated fee earner documented why they considered the merits test was met.

3.11These rates apply to cases where the work begins on or after 1 April 2016.

3.121)An application for a representation order is refused on means but granted on merits.
2)An application, properly completed, was received by the court by 09.00 on the sixth working day following the day of first instruction or earlier court hearing.
3)All reasonable steps were taken to complete and submit the form with supporting evidence.
4)No decision by the court was made before the first hearing.
5)You represent the client at the first hearing.
6)Progress is made at the first hearing or an adjournment is justified.

3.13The rate is for cases on or after 1 April 2016.
•Disbursements cannot be claimed.
•A separate claim may be made for each client.
•The claim code is PROT.
•Fees: £68.44 + VAT.
Initial advice

3.141)No early cover.
