Advice and assistance: sentence cases
4.3No claim can be made for less than 48 minutes’ work (SCC B12.101).
4.4A fixed fee of £200.75 then applies to all such cases beginning on or after 1 April 2016 unless the core costs exceed £602.25 when an hourly rates (see para 4.10 below) claim can be made (SCC B12.105–12.106).
4.5If it is clear that there is going to be an oral disciplinary or parole hearing the case must be charged as advocacy assistance as below. Advice and assistance may be given if it is not clear if there will be such an oral hearing. If an oral hearing is then listed a claim must be made at that point for advice and assistance and an advocacy assistance matter opened (SCC B12.37–12.38).

4.6These are dealt with by standard fee regimes.
4.7No claim may be made for less than 48 minutes’ work (SCC B12.120 and B12.132). If the core costs (see para 4.11 below) do not exceed the lower fee limit (LFL) a lower standard fee (LSF) is payable; if the core costs exceed the LFL but not the higher fee limit (HFL) the higher standard fee (HSF) is payable. If the core costs exceed the HFL a claim at hourly rates may then be made. No claim may be made for the amount of a fee limit (SCC B12.119, 12.121–12.122, 12.131, 12.133–12.134).
