16.19Appeals are dealt with in chapter 18. It should be noted, however, that the Court of Appeal has made clear that the bar for appealing a costs order is set high. In Re G (An Adult) (By Her Litigation Friend the Official Solicitor) (Costs),1[2015] EWCA Civ 446, [2015] COPLR 438 at para 22. Lord Justice Ryder noted that ‘an appeal against the exercise of by a judge of his discretion [in making a decision as to costs] faces a high hurdle’, and that the Court of Appeal will only interfere if the judge exceeds the generous ambit of his discretion. The same approach will also prevail in respect of appeals within the Court of Protection (ie from a lower ‘tier’ of judges to a higher ‘tier’: see further para 18.11).
