22.1Cases involving medical treatment form a distinct sub-set of the cases that are decided by the Court of Protection, and cases involving serious medical treatment have their own dedicated practice direction. They do not fall within the pathways set down under the Case Management Pilot,1Case Management Pilot PD para 3.1(d). although as discussed in paras 4.101, they may not fall outside the scope of the Case Management Pilot altogether. This chapter highlights some of the key features of such cases, but it is likely that in such cases specialist advice and representation will be required going beyond the scope of this work.2More detail about the Mental Capacity Act (MCA) 2005 and the role of the Court of Protection in medical treatment cases can be found in Christopher Johnston et al, Medical treatment, 3rd edn, Bloomsbury, 2016.
