New applications checklist – civil
If you are using CCMS, the software should ensure that it is only possible to submit an application when it is correctly completed. Unfortunately, that can be a lengthy process. This checklist is designed for paper applications
Have you used the correct version of the form?
Have all the forms been signed and dated by the client and the legal representative?
Are the signatures original and less than two months old?
Have you submitted the relevant means form?
CIV Means 1 (clients not in receipt of passporting benefits);
CIV Means 2 (clients on passporting benefits).
Has the applicant (and partner if appropriate) completed all sections of the means form and signed/dated it?
Have you submitted the relevant evidence – eg bank statements for each account, wage skips, evidence of childcare costs? Please use the checklist in form CIV Means 1 or 2
If using Form L17 is it fully completed and signed/dated by the employer?
If the client or their partner is self-employed, submit a CIV Means 1 form together with:
CIV Means 1A if sole trader;
CIV Means 1B if in partnership;
CIV Means 1C if a company director
CIV MEANS1 and CIV MEANS1 P if a prisoner.
CIV APP1 – the section relating to conditional fee agreements asks you to confirm whether a case is unsuitable for a CFA. If you believe it is unsuitable, you should answer ‘yes’ and give full reasons.
