A care plan must be a rational response to the assessment of needs
Facts: Mrs Houghton issued an application for judicial review challenging her care plan on the basis that it was not rationally justified by the assessment of her needs.
Judgment: Smith J held that the care plan seemed to bear no relationship with the assessment of needs. Therefore, the claimant’s application for judicial review would probably have succeeded and she should recover her legal costs.
