Changes of care provision are required to be justified, with reasons, in an assessment and revised support plan
Facts: Bexley provided 24 hours’ interim support per week, pending completion of an assessment, but then ceased to make that provision and failed to complete the assessment.
Judgment: Deputy High Court Judge Ter Haar allowed the application for judicial review on the basis that (i) Bexley had failed to re-assess OH’s needs and compile a revised support plan; and (ii) whilst the situation ‘cried out’ for an explanation for the reduction in care, Bexley had not provided any reasons.
