20.27Deputies are required by the OPG to produce a report each year detailing how they have managed P’s funds and with whom they have consulted with when making decisions.1MCA 2005 s19(9)(b). These reports may be audited and the OPG may require that invoices, receipts or other evidence of expenditure is submitted.
20.28From 1 March 2016 the report forms were amended to widen the scope of the report. In particular, the new reports ask for information about how recently P’s capacity was assessed. Professional deputies should note that an estimate of future costs is also required. The OPG has recently issued guidance on professional costs, which is mandatory reading for those acting in a professional capacity when completing the annual report.2https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/538901/19_07_16_Professional_deputy_costs__FINAL.pdf
20.29The annual reports are straightforward for most deputies, but lay deputies may wish to instruct an accountant or solicitor to prepare them if P’s finances are more complicated. The costs of professional advice can be met from P’s funds.
