3.68Each case must satisfy, and continue to satisfy, the merits test. There are a number of different tests, depending on the nature of the case and the type of funding sought, and they are dealt with in the relevant sections of chapters 5–11 of this book. You should always bear in mind that each merits test should be passed at the start of the case, and should continue to be passed throughout its life. If there is insufficient merit in a particular step in the proceedings, you should not take that step; if there is not, or is no longer, sufficient merit in the case as a whole, you should refuse or withdraw funding (controlled work), or report that to the LAA (licensed work).
