13.1This chapter deals with billing and payment for civil and family work. You should refer to chapters 2–12 for information on conducting cases.
13.2This chapter does not deal with contract management (which is covered in part C), but with the rules and processes for billing individual cases.
13.3See appendices H and I for a summary of the Legal Aid Agency’s (LAA’s) Costs Assessment Guidance, in respect of the most common queries raised by caseworkers.
13.4Most payment rates under the 2013, 2014 and 2015 contracts are to be found in the Civil Legal Aid (Remuneration) Regulations 2013. Some of the rates have been amended and so the latest rates are in the following instead:
Civil Legal Aid (Remuneration) (Amendment) Regulations 2013 – reduced fees for experts, and for non-family counsel, from 2 December 2013.
Civil Legal Aid (Remuneration) (Amendment) Regulations 2014 set rates for welfare benefits work under 2014 contracts.
Civil Legal Aid (Remuneration) (Amendment) (No 2) Regulations 2014 implemented remuneration changes arising from the introduction of the single Family Court.
Civil Legal Aid (Remuneration) (Amendment) (No 4) Regulations 2014 implemented changes to court bundle payments in FAS from 31 July 2014.
Civil and Criminal Legal Aid (Remuneration) (Amendment) Regulations 2015 amended the regulations to prescribe payment rates for orders under the Anti-Social Behaviour, Crime and Policing Act 2014.
Civil Legal Aid (Remuneration) (Amendment) Regulations 2015 implemented conditional payment for judicial review work done pre-permission for all certificates granted on or after 27 March 2015.
