17.56Advice on appeals can, in some circumstances, be provided under the advice and assistance scheme. Advocacy in appeal proceedings can be provided as advocacy assistance in prescribed proceedings or under a representation order.
17.57Representation in criminal appeal proceedings will require a representation order granted by the court in which the appeal is to be heard, be that the High Court (for appeals by way of case stated), the Crown Court or the Court of Appeal. It is usual for representation orders granted by the Court of Appeal to be granted to an advocate alone.1Criminal Legal Aid (Determinations by a Court and Choice of Representative) Regulations 2013 reg 8.
