5.19The scope of a referral will be determined by the legislation under which it is made. This may be further limited, if the legislation allows, by the terms of the reference to the tribunal. Usually, the reference will be limited to a live issue, but the legislation may provide that it also covers issues that may arise in the future.1As does Forfeiture Act 1982 s4(1E).
