Parties in care home closure proceedings should mediate
Facts: residents of care home accommodation submitted that the temporary closure and redevelopment of their home breached their legitimate expectations in a number of respects, including in relation to ‘home for life’ promises.
Judgment: the Court of Appeal (Ward and Sedley LJJ) refused to grant permission to appeal on the ‘home for life’ point whilst granting permission to appeal on other grounds, on the proviso that the parties were to endeavour to mediate.
