Introduction
5.1This chapter deals with the general procedures which apply to most types of civil/family case, where the procedures are very similar. There are separate chapters on family cases (private and public law), immigration and mental health, which cover their own funding schemes and rules, as well as on housing.
5.2In chapter 3, we saw that there are three key stages in providing legal aid services; to ensure that the matter is within scope, the client is financially eligible and the case meets the merits test. In addition, you need to ensure that forms are completed correctly and funding is obtained.
5.3This chapter explains how these steps are taken successfully in respect of most civil work. Most references are to the 2013 Standard Civil Contract, because most cases still in scope are governed by that Contract, but there are equivalent provisions in the other civil contracts; where there are differences between contracts, we will say so.
