8.1This chapter deals with mediation; but mainly from the point of view of a lawyer, rather than a mediator or client. There is increased emphasis on resolving disputes through mediation rather than litigation, regardless of the way that cases are funded.
8.2Used well, and complemented by legal advice, mediation helps clients find a solution to their problems in a more positive way. From April 2013, when LASPO took effect, mediation and Help with Family Mediation, (see para 6.63 above) are the only legal aid services available to clients seeking to resolve private family disputes, unless the client is the victim of domestic abuse, or likely to be so, or there is evidence of child protection concerns (see chapter 6).
