8.16Where the parties are willing and the issues are suitable, the mediation should be able to deal with all the issues arising, including explanation of the law (but not advice), and disclosure.
8.17From the client’s point of view, family mediation is advantageous, as it is exempt from the statutory charge.

setting the agenda/identification of the issues;
disclosure;
identification and exploration of options;
impasse, and strategies to break through it;
reality testing;
recording the outcome – hopefully a memorandum of understanding (MOU) and, where appropriate, an open financial statement (OFS).
8.19A lawyer is needed to advise on the law and draw up the consent order and statement of information for the court: see Help with Family Mediation – see para 6.63 above.
