9.98The amount of any costs limit depends on the stage of the case and the type of funding.
9.99In standard fee cases, save for disbursements, only the standard fee is payable unless the matter becomes an escape fee case. There is a limit on disbursements. Hourly rate cases are limited by both profits costs and disbursements. Review and reconsideration cases before the Upper Tribunal are not subject to costs limits for either costs or disbursements, since they are subject to assessment on a case-by-case basis by the LAA.
9.100These are the applicable costs limits:
Standard fee stage 1 (Legal Help):
£400 disbursements;1Standard Civil Contract Specification 2013 para 8.68.
no profit costs limits.
Standard fee stage 2 (CLR):
£600 disbursements;2Standard Civil Contract Specification 2013 para 8.68.
No profit costs limits.
Hourly rates Legal Help:
£800 profit costs (asylum); £500 profit costs (non-asylum);3Standard Civil Contract Specification 2013 para 8.80.
£400 disbursements.4Standard Civil Contract Specification 2013 para 8.84.
Hourly rates CLR:
£1,600 combined costs and disbursements (asylum)/£1,200 combined costs and disbursements (non-asylum).5Standard Civil Contract Specification 2013 para 8.86.
Bail work:
£500 for all bail work, inclusive of disbursements6Standard Civil Contract Specification 2013 para 8.86. (where CLR has not already been granted for an appeal; where it has, bail work forms part of the main £1,600/£1,200 limit. If CLR has already been granted for bail, when it is granted for a substantive appeal, the costs already spent on bail count towards the £1,600/£1,200).7Standard Civil Contract Specification 2013 para 8.87.
9.101Any of the above limits can be extended on application to the LAA. In addition, there are limits for specific case stages:
Where a client instructs you prior to making an application at the Asylum Screening Unit (ASU), and following attendance at the ASU you cease to be instructed – £100 including disbursements.
Where advice is given on the merits of an appeal to the Upper Tribunal under Legal Help (usually because the case has transferred to you at this stage, otherwise such advice would be part of CLR stage 2b) – £100 including disbursements.
Where you provide initial advice in relation to an asylum application which the client decides not to make or ceases to provide instructions before making – £100 including disbursements.
