15.1This chapter deals with the conduct of and payment for advocacy in civil cases and the general rules applying to both civil and family cases.
15.2In general, we use the term ‘advocate’ to refer to anyone who has a right of audience to appear in the relevant court or who the court is willing to hear where the scheme makes no distinction between solicitor and counsel. Where there is a difference according to whether advocacy is conducted by solicitor or by counsel, we will use the terms ‘solicitor’ and ‘counsel’ as appropriate.
15.3This chapter only deals with the advocacy aspects of cases. For more information on the conduct of litigation, see Part A of this book. For information on the particular rules applying in family and criminal cases, see chapters 16 and 17.
