16.1This chapter deals with the particular rules that apply to conduct of and payment for advocacy in family cases. See chapter 15 for the general rules applying to both civil and family cases.
16.2Advocacy can only be conducted under legal representation certificates in family work as Help at Court and Controlled Legal Representation (CLR) are not available in the family category.
16.3In general, we use the term ‘advocate’ to refer to anyone who has a right of audience to appear in the relevant court or whom the court is willing to hear, where the scheme does not make a distinction between solicitor and counsel. Where there is a difference according to whether advocacy is conducted by solicitor or by counsel, we will use the terms ‘solicitor’ and ‘counsel’ as appropriate.
16.4This chapter only deals with the advocacy aspects of family cases. For more information on the conduct of litigation, see Part A of this book. For information on the rules applying in criminal cases, see chapter 17, and chapter 15 for other civil cases.
