16.6The Family Graduated Fee Scheme (FGS) continues to apply to these cases. The provisions of the scheme are set out in the Community Legal Service (Funding) (Counsel in Family Proceedings) Order 2001 as amended. It is unlikely that there are many outstanding cases to which this scheme applies.
Scope of the FGS
16.7The FGS applies only to counsel. Solicitor advocates claim under the appropriate standard fee or hourly rate scheme, depending on whether the case is public or private law, and whether the case started prior to 1 October 2007.
16.8Payments under the FGS are essentially fixed or standard fee payments with a range of base fees for different pieces of work. These fees are set according to the nature of the proceedings, the work to be done, whether junior or leading counsel is employed, and venue. There is also a range of additional payments that may be added to the fee due, to reflect special features and complexity. The permutation of possible payments is quite complex.
