The European Committee of Social Rights upheld as admissible EUROCEF’s complaint that France was failing to discharge its duty under the revised European Social Charter to provide housing, social and medical assistance, social welfare and other benefits to unaccompanied minors, seeking asylum in France or living irregularly in France
Facts: EUROCEF complained about problems in the process of assessing whether unaccompanied young foreigners are minors; shortcomings in initial reception arrangements and very long delays in care provision, which take no account of the vulnerability of young people and the need to satisfy their basic needs and provide them with social and educational support. EUROCEF relied on Articles 7, 11, 13, 14, 17, 30 and 31 of the revised European Social Charter.
Judgment: the Committee declared the complaint admissible
