7.3The Very High Cost (Crime) Cases Arrangements 2013 and SCC 7.3 set out the notification rules and identify the features which will, for costs purposes, classify the case. In Part B the Arrangements identify the eligibility criteria for litigators or advocates to undertake cases of over 60 days. Part C contains the eligibility criteria for shorter VHCC cases.
7.4Notification is required of any case likely to last 25 days or more as soon as it appears that the case is likely to be a VHCC and in any event within five working days of the earliest hearing at which the court sets a length of trial estimate or the defence team has identified that the case will be or is likely to be a VHCC.
7.5A failure to notify without good reason enables the LAA to refuse to pay the firm in question costs to the value of any loss resulting.1Remuneration Regulations 2013 reg 12(2).
