7.12There is a presumption that, once a case is accepted as a VHCC case, that classification will be maintained. However if a case is declassified all the work will again be undertaken under the relevant graduated fee scheme.
7.13Where a case ceases to be a very high cost case and the fee reverts to the normal methods of payment to a litigator or an advocate, the litigator or advocate must repay any money paid under the VHCC contract. However, if they were a case manager there will, in addition, be payable an administration fee for the administrative work associated with the VHCC contract. The fee is calculated as a fee for three hours’ work for each stage or part stage except for pre-contract work (stage O) or part of a stage up to the date of declassification.
